IVY LETTINGS RENTAL AGREEMENT
We’re delighted to host you. This agreement sets out the terms of your stay and helps ensure a smooth experience for both guests and homeowners.
This Rental Agreement (“Agreement”) is made between the guest (“Guest”) and the owner of the property (“Host”), arranged by Ivy Lettings Limited (“Agent”).
This Agreement operates in conjunction with the Guest Terms of Business and the Confirmation of Booking.
In the event of any conflict, the Guest Terms of Business shall take precedence in respect of commercial terms (including cancellation, refunds, and payments).
1. Booking and Formation
A binding agreement is formed when the applicable booking payment has been successfully processed and the Agent has issued a Confirmation of Booking.
The Agent reserves the right to decline any booking request prior to confirmation.
2. Property and Term
The Host grants the Guest a personal licence to occupy the property (“Property”) for holiday accommodation only for the period stated in the Confirmation of Booking (“Term”).
This Agreement does not create a tenancy or grant exclusive possession.
3. Payment
All payment terms are governed by the Guest Terms of Business and the Confirmation of Booking.
The Guest remains liable for any additional charges incurred during the stay, including damages, additional services, or breaches of this Agreement.
4. Security Deposit
A security deposit will be taken or pre-authorised prior to check-in in accordance with the Guest Terms of Business.
The Agent may deduct sums for:
- Damage, loss or breakage
- Breach of this Agreement
- Additional cleaning required
- Missing items
- Fines, penalties or call-out costs
- The Guest remains liable for any costs exceeding the deposit.
5. Cancellation and Amendments
Cancellation, amendments, refunds and related terms are governed by the Guest Terms of Business and the Confirmation of Booking.
6. Check-In and Check-Out
The Guest must check in and check out at the times specified.
Unauthorised late check-out will incur charges as set out in the Guest Terms of Business or equivalent to a full day’s Rent.
If the Guest remains in occupation more than two hours beyond check-out without agreement, the Agent may enter the Property, remove belongings, change locks and take steps to recover possession. The Guest shall be liable for all associated costs.
7. Occupancy and Use
The Property may only be occupied by the persons named in the booking and must not exceed the maximum occupancy.
The Guest agrees not to:
- Hold parties or events
- Use the Property for commercial purposes (including filming or photography)
- Cause nuisance or disturbance
- Allow unauthorised occupants
8. Looking After the Property
The Guest agrees to:
- Keep the Property clean and in good condition
- Dispose of rubbish appropriately
- Use appliances, plumbing and utilities responsibly
- Not overload electrical systems
- Keep vents and extraction systems clear
- Avoid putting grease or harmful substances into drains
The Guest shall be responsible for the cost of repair or replacement of any damage caused by their actions or negligence.
9. Property Condition
The Guest must report any damage, defect or missing items within 24 hours of check-in. Failing this, the Property will be deemed accepted in good condition.
10. Access
The Agent or Host may enter the Property with reasonable notice for maintenance, inspection or compliance purposes, or without notice in an emergency.
11. Keys and Security
The Guest must secure the Property when unoccupied and return all keys or access devices at the end of the stay.
Lost keys or failure to return keys may result in lock replacement charges.
12. Insurance and Liability for Actions
The Guest must not do anything that may invalidate the Host’s insurance.
The Guest is responsible for any increased insurance costs, claims or losses arising from their actions.
Personal belongings are not covered by the Host’s insurance.
13. Ending a Stay
The Agent (on behalf of the Host) may terminate the stay immediately without refund in the event of serious breach, including:
- Unauthorised parties or gatherings
- Illegal activity
- Excess occupancy
- Significant nuisance or damage
14. Complaints
The Guest must notify the Agent promptly of any issue.
The Agent must be given a reasonable opportunity to investigate and resolve any problem.
Failure to do so may affect any entitlement to compensation.
15. Relocation
If the Property becomes unavailable or uninhabitable, the Agent may offer alternative accommodation of a similar or higher standard.
If relocation is not possible or not accepted, any refund or compensation shall be limited to the rental amount for the affected period.
16. Liability
Liability is further governed by the Guest Terms of Business.
To the fullest extent permitted by law, neither the Host nor the Agent shall be liable for indirect or consequential losses, including loss of enjoyment, travel costs or business losses.
Total liability shall be limited to the Rent paid.
17. Force Majeure
Neither the Host nor the Agent shall be liable for failure to perform obligations due to events beyond reasonable control, including natural disasters, government actions, utility failures or external disruptions.
18. Privacy
The Guest must not disclose the address, security details or identity of the Host.
The Property must not be used for publicity, media or commercial purposes without consent.
19. Smoking and Pets
Smoking is prohibited unless agreed.
Pets are not permitted without prior approval.
20. Data Protection
Personal data is processed in accordance with UK GDPR and the Data Protection Act 2018.
21. General
If any provision is invalid, the remainder shall remain in force.
This Agreement is governed by the laws of England and Wales.
